Ithaca Bound Inc. is operating as EVOO and EVOO App. Ithaca Bound Inc. is federally incorporated in the Country of Canada. In this User Notice, when referencing Ithaca Bound Inc., EVOO or EVOO App, they are all treated as one and of the same company. By using this website (hereinafter, “website”) You agree to abide by this User Notice. In this User Notice you are referred to as “You”. Further, the terms “customer”, “user”, “customers” & “users” encompasses You.

This User Notice was written with the intention of being reasonably understandable.

In this User Notice, when referring to You and Ithaca Bound Inc. collectively, they will be referred to as the “Parties”.

  1. Intellectual property rights. Ithaca Bound Inc. owns the copyright and all other intellectual property rights on the website and the EVOO mobile application including but not limited to: the software code, the EVOO App brand, & the EVOO App designs. Content that users post onto the EVOO mobile application (“User content”) is handled differently and is covered in the Terms of Service.
  2. Protecting personal information. EVOO does not share the personal information of its users and customers with third parties that are at arm’s length ownership of Ithaca Bound Inc. unless in the case of providing the Services and other operational activities, and only then would such Service Providers be under an applicable Confidentiality Agreement and/or be required to adhere to applicable privacy legislation. Personal information that is shared outside of the foregoing parameters would only be done so after obtaining consent from a user.
  3. Internet protocol addresses. EVOO may store web-based cookies or track Internet Protocol (IP) addresses for the purposes of displaying content to users, to provide the Services, for advertising purposes, and for other operational purposes. Aside from what is required to fulfill the Services, Ithaca Bound Inc. does not track or store the personal information of its users.
  4. Suggestions. EVOO welcomes ideas and suggestions to improve the website, the EVOO mobile application and Ithaca Bound Inc., but by making a suggestion, You will do so without any expectation to gain a benefit in exchange for providing the suggestion or idea.
  5. As-is. You agree to use the website and Services as-is. Ithaca Bound Inc. doesn’t warrant the accuracy of the content on the website nor that the website will be available at all times.
  6. Updates to this notice. Updates to this User Notice may occur from time to time at the discretion of EVOO. The most current version of this User Notice will be at or made available through evooapp.com, and will come into effect immediately upon publication. By continuing to use this website after, You agree to abide by the then current User Notice.

  8. Enforceability. If a section of this User Notice is deemed by an authoritative judicial body as unenforceable, the Parties agree that the authoritative judicial body, or a body selected by the authoritative body, may amend such section to match the reasonable intent of why the section was created in the first place so that it can then be legally enforceable as it was intended to be.
  9. Section subtitles. The subtitles of the sections in this User Notice are to assist with better formatting and readability but aren’t intended to be legally enforceable.
  10. Jurisdiction. The laws and the courts of Canada and the Province of Ontario, Canada, have jurisdiction over this User Notice.
  11. Entire agreement. This User Notice supersedes any and all other agreements and understandings between You and Ithaca Bound Inc. regarding the subject matter herein, whether verbally, written, implied, or expressed. This User Notice can only be amended by both You and Ithaca Bound Inc. agreeing to such amendments in writing and mutually signing, or by what is permissible as per this User Notice. Despite the above information in this section, if the Terms of Service between the Parties contradicts this User Notice, the Terms of Service will supersede this User Notice.
